Prohibiting High
Grass, Weeds,
and debris in
Borough
This Ordinance was Repealed January 2005 with the Nuisance Ordinance 2 of 2005.
Prohibiting high grass, weeds, rubbish, and debris on real estate within the Borough of Bolivar and imposing Penalties for the violation thereof.
Be it enacted and ordained by the Borough of Bolivar and it is hereby enacted and ordained by the authority of the same.
Section 1. That it shall be unlawful for the owner and / or occupant, tenant or lessee of any parcel or lot of ground within the Borough of Bolivar to permit grass and / or weeds to grow thereon to a height exceeding 18 inches.
Section 2. That it shall be unlawful for the owner and / or occupant, tenant, or lessee of any parcel or lot of ground situate within the Borough of Bolivar to permit rubbish and / or debris to accumulate and be stored thereon.
Section 3. That if within five (5) days following the mailing of a notice of any violation of either of the provisions of this order once to the address, if knowing of the owner and / or occupant, tenant, or lessee, or within five (5) days following the posting of a notice of any such violation on the parcel or lot of ground concerned, if the address of the owner and / or occupant, tenant, or lessee is unknown, said violation and to make said lot or parcel of ground conform with the provisions of this Ordinance shall be performed by the employees retained by the Borough of Bolivar and the cost thereof together with a charge of 25% shall, be charged against and collected from the owner and / or occupant, tenant or lessee of said ground as other debts due and owing the Borough of Bolivar are collected.
Section 4. Any owner and / or occupant,. tenant, or lessee of any lot or parcel of ground situated within the Borough of Bolivar who shall violate any of the provisions of this Ordinance shall upon conviction before the Burgess of the Borough of Bolivar or a Justice of the Peace be sentenced to pay a fine of not less than $5.00 nor more than $25.00 plus costs for each offense, and in default of payment of said fine such person or persons shall be committed to the county Jail of Westmoreland County Pennsylvania for a period not exceeding ten (10) days providing, however, that the payment of said fine shall not release the person or persons violating the provisions of this Ordinance from payment of the costs to correct said violations as recited in Section 3 of this Ordinance.
Section 5. That all Ordinances or Resolutions or parts thereof inconsistent herewith be and the same are hereby repealed. 2
